Placer Land Trust, Pulte, and PL Roseville LLC have resolved the pending litigation over the application of the 0.5% re-sale fee to homes within The Club at Westpark by Del Webb. As of July 27, 2012, the parties reached a full and complete settlement of this dispute that resolves the issue of whether homes within The Club are subject to the re-sale fee. The settlement was then sent to the Placer County Superior Court for approval, which was recorded and transmitted to the parties on October 5, 2012.
The official Judgment For Declaratory Relief is attached. In summary, the parties compromised by agreeing that the 306 homes and future homesites still owned by Pulte/Del Webb, or sold by Pulte/Del Webb on or after September 1, 2011, will be subject to the 0.5% re-sale fee, which will be collected on future re-sales of these homes for a period of twenty (20) years from the date of initial sale of each home. The 306 homes and lots that will be subject to the re-sale fee are identified on the attached Exhibit A. The parties agreed that all 398 homes within The Club that were sold by Pulte/Del Webb prior to September 1, 2011, will be permanently and fully exempt from the re-sale fee from this time forward. The agreement does not change or affect re-sale fees already paid to Placer Land Trust on any of those 398 homes. The 398 homes that are exempt from the re-sale fee from this time forward are identified on the attached Exhibit B.
Pulte and Placer Land Trust are in the process of collecting addresses to mail this information to all homeowners, and to title and escrow companies doing business in the area to eliminate any future confusion as homes within The Club are re-sold in the future.
